These Terms and Conditions apply to your use of nickpackard.com and related sites, including picklefarts.com and nickisatool.com (together, the “Site”), and to any purchase made through the Site. The Site is operated by NP Connect (“we,” “us,” “our”), 7761 W Ryan Rd #202, Franklin, WI 53132. By using the Site or placing an order, you agree to these terms.
1. Use of the Site
You agree to use the Site lawfully and not to misuse it, including attempting to hack it, interfere with its operation, scrape it, or use it to send spam or harmful content. We may suspend access to anyone who violates these terms.
2. Services
NP Connect provides marketing, consulting, fractional CMO, website, workshop and related services. Any paid services are governed by a separate written proposal or agreement between you and NP Connect. If anything in that agreement conflicts with these terms, the agreement controls.
3. Free assessments
- Our free marketing assessment comes with no cost and no obligation.
- Assessments are general guidance based on the information you provide and what we can review. They’re not a guarantee of any result.
- Information you share for an assessment is kept confidential and used only to prepare your assessment and follow up with you about it.
- We may decline or limit assessment requests at our discretion.
4. Results disclaimer
Campaign results, numbers, case studies and testimonials on the Site and in the book reflect past experiences of NP Connect and its clients. They’re not a promise or guarantee of future results. Your results will depend on your business, your market, your effort and how stupid you’re willing to get.
5. Forms and communication
When you submit a form on the Site, you agree that we may contact you by email or phone about your request. If you join our email list, you can unsubscribe at any time using the link in any email.
6. Free tools and content
Templates, checklists, calculators and other tools offered on the Site, including at nickisatool.com, are provided free and “as is” for your personal and business use. They’re for general information only and don’t constitute legal, financial or tax advice.
7. Book orders
Products: we sell signed paperback and hardcover copies of Picklefarts: Stupid Ideas. Smart Marketing. by Nick Packard, and occasionally related products. Product images are for illustration, and the actual item may vary slightly.
Preorders:
- Books ordered before the official release date of November 1, 2026 are preorders and are charged at the time of purchase.
- We plan to ship preorders by October 24, 2026, so they arrive before the release date. Ship dates are estimates. If printing or shipping delays happen, we’ll email you an updated date.
- If we can’t fulfill a preorder, we’ll refund you in full.
Signed copies: every book ordered through the Site is signed by Nick Packard. Signatures aren’t personalized unless we offer personalization and you request it.
Pricing and payment:
- All prices are in U.S. dollars.
- Payments are processed securely by our payment provider, and we don’t store your full card information.
- Sales tax is added where required by law.
- We may correct pricing errors and cancel orders placed at an incorrect price, with a full refund.
Shipping:
- We currently ship within the United States only.
- Shipping is charged at the flat rate shown at checkout.
- You’ll receive a confirmation email with tracking once your order ships.
- We’re not responsible for delays caused by carriers, weather or incorrect addresses, so please double-check your shipping address.
Cancellations, returns and refunds:
- Before shipping: cancel anytime for a full refund by emailing us before your order ships.
- After shipping: because every book is signed, we don’t accept returns of undamaged books.
- Damaged or wrong item: email us within 14 days of delivery with your order number and a photo, and we’ll replace it or refund you, your choice.
- Lost packages: if tracking shows your package hasn’t arrived within a reasonable time, contact us and we’ll work with the carrier to resolve it.
- Refunds go back to the original payment method and may take 5–10 business days to appear.
8. Intellectual property
All content on the Site, including text, images, videos, logos, the Picklefarts name and characters, the book and the tools, belongs to Nick Packard and NP Connect and is protected by copyright and trademark law. You may not copy, reproduce, resell or distribute it without written permission, except for brief quotes with credit.
9. Third-party links and services
The Site may link to third-party websites and services, such as Amazon, other retailers, social media and payment processors. We’re not responsible for their content, policies or practices.
10. Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” We don’t guarantee the Site will always be available, error-free or secure.
11. Limitation of liability
To the fullest extent allowed by law, NP Connect is not liable for indirect, incidental, special or consequential damages arising from your use of the Site, our free tools or our products. For any purchase made through the Site, our total liability is limited to the amount you paid for that purchase. Liability for paid services is governed by your service agreement.
12. Privacy
We collect only the information needed to respond to your requests, process and ship orders, and communicate with you. We don’t sell your personal information. See our Privacy Policy for details.
13. Governing law
These terms are governed by the laws of the State of Wisconsin. Any disputes will be handled in the state or federal courts located in Milwaukee County, Wisconsin.
14. Changes
We may update these terms from time to time. The “Last updated” date shows the latest version, and changes apply from the date they’re posted.
